In this paper, I ask whether mishpat ivri (Jewish Law) is appropriately conceived as a “legal system”. I review Menachem Elon’s use of a “Sources” Theory of Law (based on Salmond) in his account of Mishpat Ivri; the status of religious law from the viewpoint of jurisprudence itself (Bentham, Austin and Kelsen); then the use of sources (and the approach to “dogmatic error”) by halakhic authorities in discussing the problems of the agunah (“chained wife”), which I suggest points to a (...) theory more radical than the “sources” theory of law, one more akin to the ultimate phase of the thought of Kelsen (the “non-logical” Kelsen) or indeed to some form of Legal Realism (with which that phase of Kelsen’s thought has indeed been compared)? Nelson's Proof of the Impossibility of the Theory of Knowledge -/- In addressing the possibility of a theory of knowledge, Leonard Nelson noted the contradiction of an epistemological criterion that one would require in order to differentiate between valid and invalid knowledge. Nelson concluded that the inconsistency of such a criterion proves the impossibility of the theory of knowledge. -/- Had the epistemological criterion had a perception, then it would presume to adjudicate on its own truth (thus epistemological circular argument). (...) However, if one were to assume that the criterion is not knowledge, one would then have to justify how this is a criterion for truth - yet this would only be possible when it may be considered as an object of knowledge. One would equally have had to predetermine the criterion in order to determine the truth of this knowledge, thereby providing another circular argument. Ostensibly, every criterion of truth fails at its very own test since it cannot guarantee its own truth, just as Munchausen, contrary to his assertion, could not draw himself out of the swamp by tugging on a tuft of his own hair. -/- Nelson proposed a solution of the epistemological problem (the question of the differentiation between valid and invalid knowledge), that based on Jakob Friedrich Fries' differentiation between proof and deduction. Proof, according to Nelson (in reference to Fries), can be defined as derivation of truth from one statement from another statement. Thus, from the truth in the statement that "all men are mortal", one is then able to say that "Socrates is a man" and thence extrapolate from the truth of the statement that "Socrates is mortal." If knowledge were to be considered somewhat judgmental (in a statement), then an attempt at proof (i.e. recourse to previous judgments) would inevitably lead to an infinite regression in justification, since each judgment would necessitate a further justification from another judgment. Every attempt to prove an epistemological criterion is thus also confronted by this regression in justification. -/- Nelson's attempt at a solution rests on the assumption of the existence of an immediate knowledge as a justification of the truth (mediate) of knowledge. Nelson considers immediate knowledge to be non-judgmental knowledge. These include intuitions (e. g. seeing-the-red-roof) and also philosophical knowledge that pre-exists in his opinion before a judgmental reflexion (immediate) in our reason (e. g. the principle of causality). -/- Proof of the truth of mediate knowledge can be effected by showing its compliance with attendant immediate knowledge (rational truth = correspondence of mediate knowledge with their immediate knowledge). Nelson considered this as a resolution of the circular epistemological argument. In regard to philosophical knowledge, Nelson sees these as subject to deduction and not proof. The question of time travel stimulates the imagination and provides material for whimsical stories. A work on the topic of "time travel" forces us to deal with the concept of "time". The complexity and the antinomic character of this concept make it difficult to grasp "time" more precisely. We encounter time as a form of perception in its deeply subjective aspect, as a biological rhythm, as a social phenomenon in the sense of a collective determination of time, but also as (...) a physical quantity. Einstein's theory of relativity revolutionized our ideas of space and time. His Special Theory of Relativity (1905) allows "travel into the future" through the effect of time dilation he predicted, and Einstein's theory of gravity allows for closed time lines as solutions to its equations (e.g., Gödel cosmos, anti-de Sitter cosmos). However, traveling in a time loop would immediately lead to a number of paradoxes (e.g., grandfather paradox, information paradox). Although, surprisingly, the basic laws of physics (apart from extremely rare and macroscopically non-appearing quantum mechanical effects) would not be violated in a time reversal, there seems to be a fundamental prohibition of traveling into the past in nature. The problem of synthetic judgements touches on the question of whether philosophy can draw independent statements about reality in the first place. For Kant, the synthetic judgements a priori formulate the conditions of the possibility for objectively valid knowledge. Despite the principle fallibility of its statements, modern science aims for objective knowledge. This gives the topic of synthetic a priori unbroken currency. This paper aims to show that a modernized version of transcendental philosophy, if it is to be feasible at (...) all, must “bid farewell” to the concept of being “free of empiricism” or the “purity” of the a priori. Approaches to this end can already been found in Kant’s reflections on non-pure synthetic knowledge. Moreover, the a priori validity of knowledge does not exclude the possibility that it can be discovered empirically. In keeping with Kant, Fries and Nelson anticipated this separation (usually first attributed to Reichenbach) between the validity and discovery context of knowledge and pointed out that the a priori could be discovered empirically, but never proven. There are currently still good reasons why transcendental philosophical concepts are of fundamental importance for modern science, although it must not be overlooked that even within the framework of a modernized transcendental philosophy, several unsolved problems remain or are raised. For example, the irredeemability of the universal validity and necessary claims of the a priori, the problem of a clear demarcation between the phenomenal and noumenal world. Moreover, the “beautiful structure” or the Kantian system, which constituted its persuasive power, is lost. (shrink)

This study investigates the dynamics of brick-and-mortar versus click-and-mortar microbusinesses, focusing on the strengths, weaknesses, opportunities, and threats (SWOT) within the local context of Balayan. Ten purposively sampled microbusiness entrepreneurs were examined using the SWOT method. The findings underscore the significance of product assessment, communication, and customer experiences in cultivating trust. Sensory experiences and competitive pricing emerge as strengths, while challenges such as poor sales necessitate strategic interventions. External factors, particularly technological advancements, exert influence on the retail landscape. Key strategies (...) include competitive pricing, flexibility, and an understanding of customer behavior. The study highlights growth potential in tailored experiences but acknowledges the risks posed by e-commerce competition. Additionally, a SWOT strategic plan is developed to leverage internal and external strengths and opportunities while mitigating weaknesses and threats. (shrink)

Subjectivists about practical normativity hold that an agent’s favoring and disfavoring attitudes give rise to practical reasons. On this view, an agent’s normative reason to choose vanilla over chocolate ice cream ultimately turns on facts about what appeals to her rather than facts about what her options are like attitude-independently. Objectivists—who ground reasons in the attitude-independent features of the things we aim at—owe us an explanation of why it is rational to choose what we favor, if not because favoring is (...) a source of reasons. My aim in this paper is to supply such a story. The proposal is roughly that when an agent cannot base her choices on her judgments about what she has most reason to do, structural rationality extends to her a license to choose something just because she favors it, without imbuing favoring with the authority of a normative reason. We develop an approach to the problem of de se belief usually expressed with the question, what does the shopper with the leaky sugar bag have to learn to know that s/he is the one making the mess. Where one might have thought that some special kind of “de se” belief explains the triggering of action, we maintain that this gets the order of explanation wrong. We sketch a very simple cognitive architecture that yields de se-like behavior on which the (...) action-triggering functionality of the belief-state is what counts it as de se rather than some prior property of being “de se” explaining the triggering of action. This functionality shows that action-triggering change in belief-state also undergirds a correlative change in the objective involved in the triggered action. This model is far too simple to have any claim to showing how the de se works for humans, but it shows, by illustration, that nothing mysteriously “subjective”” need be involved in this aspect of self-conception. While our exposition is very different from those of Perry and Recanati, all three of us are developing the same kind of view. (shrink)

However, it must not be neglected that, even within a modernized framework of transcendental philosophy various unsolved problems remain and/or are created (such as the unfeasibility of the aprioristic claim to general validity and necessity, the problem of drawing a clear boundary between the noumenal and phenomenal worlds). The problem of time involves an overlap between physics, philosophy, psychology and neuroscience. My talk will discuss the role of time in physics but also emphasize that physics may need to expand to address issues usually regarded as being in the other domains. I will first review the mainstream physics view of time, as it arises in Newtonian theory, relativity theory and quantum theory. I will then discuss the various arrows of time, the most fundamental of which is the passage (...) of time associated with consciousness. I will argue that this goes beyond both relativity theory and quantum theory, so that one needs some new physical paradigm to accommodate it. A new paradigm is required anyway to describe quantum gravity and this may elucidate the nature of both time and consciousness. (shrink)

Economic pressures, mounting environmental, security and health requirements, are all critical factors that shape economic action. With regard to environmental protection, an economic entity acting as homo oeconomicus finds himself in a situation resembling a prisoner’s dilemma. Signposts for a possible resolution of this dilemma include an environmental management system, a system of environmental law based on the principles of environmental ethics, and a new conception of human nature.

This paper investigates the strange case of an argument that was directed against a positivist verification principle. We find an early occurrence of the argument in a talk by the phenomenologist Roman Ingarden at the 1934 International Congress of Philosophy in Prague, where Carnap and Neurath were present and contributed short rejoinders. We discuss the underlying presuppositons of the argument, and we evaluate whether the attempts by Carnap (especially) actually succeed in answering this argument. We think they don’t, and offer (...) instead a few sociological thoughts about why the argument seems to have disappeared from the profession’s evaluaton of the positivist criterion of verifiability. Ernst Mally’s Gegenstandstheoretische Grundlagen der Logik und Logistik (1912) proposes that the abstract object “the circle” does not satisfy the properties of circles, but instead “determines” the class of circles. In this he anticipates the notion of “encoding” that Edward Zalta proposes for his theory of Abstract Objects. It is argued that Mally did anticipate the notion of “encoding”, but sees it as a way of taking the concept as the subject of a proposition, rather than as a primitive notion (...) in the theory of a new ontological category of abstract objects, as Zalta does. Ian Stevenson's achievements lay not only in the corpus of his written works but also in the influence he had on colleagues whom he exhorted to take an interest in the subject from other fields. One of them is Bernard Carr. Stevenson showed much enthusiasm talking about Carr's two experiments with the Cambridge University Society for Psychical Research, one involving an attempt to detect the telepathic transmission of emotion using hypnotized subjects and psychogalvanic skin response and the other was (...) an investigation of the relative roles of telepathy and clairvoyance in extrasensory perception. Stevenson meticulously read and commented on his work and even invited him to visit his group with the intention of preparing reports for publication. Carr was grateful for the passion he instilled in him for psychical research as a result of these experiences. (shrink)

This three-part paper presents Gordon Pask’s conversation theory (CT) and interaction of actors theory (IA) and outlines ways to apply these cybernetic approaches to designing technologies and scenarios for both formal and informal learning. The first part of the paper covers concepts central to CT and IA, explaining the relationship between conceptual and mechanical operators, and machines mediating informal and formal learning. The second part of the paper applies visual representations of CT and IA to understanding the use of Pask’s (...) course assembly systems (CASTE and THOUGHTSTICKER), created between the late 1960s and the 1980s, and the ThoughtShuffler search interface, created in the 2010s. The third part proposes two pathways for design based on CT and IA: firstly, the potential for designers and observers to reformulate the qualities of tools and learning scenarios to augment human thinking and collective action; and secondly, the possibility to create tools with malleable interfaces that allow users to become intermediaries rather than consumers of knowledge. Levi ben Gerson (1288–1344) was a medieval astronomer who responded in an unusual way to the Ptolemaic tradition. He significantly modified Ptolemy’s lunar and planetary theories, in part by appealing to physical reasoning. Moreover, he depended on his own observations, with instruments he invented, rather than on observations he found in literary sources. As a result of his close attention to the variation in apparent planetary sizes, a subject entirely absent from the Almagest, he discovered a new phenomenon of Mars (...) and noticed a serious flaw in Ptolemy’s treatment of the Moon. A common and enduring early modern intuition is that materialists reduce organisms in general and human beings in particular to automata. Wasn’t a famous book of the time entitled L’Homme-Machine? In fact, the machine is employed as an analogy, and there was a specifically materialist form of embodiment, in which the body is not reduced to an inanimate machine, but is conceived as an affective, flesh-and-blood entity. We discuss how mechanist and vitalist models of organism exist in a more complementary (...) relation than hitherto imagined, with conceptions of embodiment resulting from experimental physiology. From La Mettrie to Bernard, mechanism, body and embodiment are constantly overlapping, modifying and overdetermining one another; embodiment came to be scientifically addressed under the successive figures of vie organique and then milieu intérieur, thereby overcoming the often lamented divide between scientific image and living experience. Results: We analyzed 1,402 surveys and 15 in-depth interviews. Many (32%) CL participants reported greater difficulty refilling medications and a minority (14%) reported greater difficulty accessing HIV care during the pandemic. Most (99%) Opt4Mamas participants reported no difficulty refilling medications or accessing HIV/pregnancy care. Among the CL participants, older women were less likely (aOR = 0.95, 95% CI: 0.92–0.98) and women with more children were more likely (aOR = 1.13, 95% CI: 1.00–1.28) to report difficulty refilling medications. Only 2% of (...) CL participants reported greater difficulty managing FP and most (95%) reported no change in likelihood of using FP or desire to get pregnant. Qualitative analysis revealed three major themes: (1) adverse organizational/economic implications of the pandemic, (2) increased importance of pregnancy prevention during the pandemic, and (3) fear of contracting COVID-19. Judgment subjectivism is the view that x is good for S if and only if, because, and to the extent that S believes, under the proper conditions, that x is good for S. In this paper, I offer three related arguments against the theory. The arguments are about what judgment subjectivism implies about the well-being of welfare nihilists, people who believe there are no welfare properties, or at least that none are instantiated. I maintain that welfare nihilists can be benefited (...) and harmed. Judgment subjectivism is implausible because it implies otherwise. (shrink)

The article describes the background of Roman Ingarden's 1922 review of Leon Chwistek's book Wielość rzeczywistości, and the back-and-forth that followed. Despite the differences, the two shared some interesting similarities. Both authors had important ties to the intellectual happenings outside Poland and were not considerd mainstream at home. In the end, however, it is these connections that allowed them to gain recognition. Ingarden, who had been a student of Husserl, became the leading phenomenologist in the postwar Poland. For Chwistek, a (...) painter, philosopher, and logician interested in Russell’s work, such connections meant that he won the competition for a professorship at the university in Lwów over Alfred Tarski. Until recently, Chwistek’s place in Polish logic remains unclear and Ingarden’s interactions with Polish logic and the Vienna Circle have not been investigated extensively. A deeper look at this intellectual fracas between Ingarden and Chwistek helps one in the study of the complicated mesh of alliances within the Lwów-Warsaw School. The article also identifies the origins of the split between phenomenology and the analytic philosophical tradition in Poland. The article is also accompanied by the translations of the reviews. This is the first English translation of Leon Chwistek’s “Tragedia werbalnej metafizyki,” Kwartalnik Filozoficzny, Vol. X, 1932, 46–76. Chwistek offers a scathing critique of Roman Ingarden’s Das literarische Kunstwerk and of the entire Phenomenology movement. The text also contains many hints at Chwistek’s own philosophical and formal ideas. The book that Chwistek reviews attracted wide attention and was instrumental in winning Ingarden a position as Professor of Philosophy at the University of Lwów in 1933. Chwistek’s alienation from his fellow logicians (...) of the Lvov-Warsaw school is clear from his ridicule of Leśniewski’s project. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

In today’s society of humans and machines, automation, animation, and ecosystems are terms of concern. Categories of life and technology have become mixed in governmental policies and drive economic exploitation and the pathologies of everyday life. Abstract In light of the complexity of unfolding disasters, the diversity of rapidly evolving events, the enormous amount of generated information, and the huge pool of casualties, emergency responders (ERs) may be overwhelmed and in consequence poor decisions may be made. In fact, the possibility of transporting the wounded victims to one of several hospitals and the dynamic changes in healthcare resource availability make the decision process more complex. To tackle this problem, we propose a multicriteria decision support service, based (...) on the Analytic Hierarchy Process (AHP) method, that aims to avoid overcrowding and outpacing the capacity of a hospital to effectively provide the best care to victims by finding out the most appropriate hospital that meets the victims’ needs. The proposed approach searches for the most appropriate healthcare institution that can effectively deal with the victims’ needs by considering the availability of the needed resources in the hospital, the victim’s wait time to receive the healthcare, and the transfer time that represents the hospital proximity to the disaster site. The evaluation and validation results showed that the assignment of hospitals was done successfully considering the needs of each victim and without overwhelming any single hospital. (shrink)

This article explores the potential of Bernard Lonergan’s philosophy of subjectivity as objectivity as a grounding for value sensitive design (VSD) and the design turn in applied ethics. The rapid pace of scientific and technological advancement has created a gap between technical abilities and our moral assessments of those abilities, calling for a reflection on the philosophical tools we have for applying ethics. In particular, applied ethics often presents interconnected problems that require a more general framework for ethical reflection. (...) Lonergan’s philosophy, which emphasizes the importance of selfunderstanding and self‐transcendence in achieving objectivity, can provide a valuable perspective on VSD and the design turn in applied ethics. The article examines how Lonergan’s philosophy can be applied to VSD and the design turn, and how scientific knowledge can be integrated into an ethics of science without reducing it to an external reflection. By adopting Lonergan’s perspective, we can address the ethical challenges arising from scientific and technological advancements while promoting a more holistic approach to applied ethics. (shrink)

In Beyond Physicalism, an interdisciplinary group of physical scientists, behavioral and social scientists, and humanists from the Esalen Institute’s Center for Theory and Research argue that physicalism must be replaced by an expanded scientific naturalism that accommodates something spiritual at the heart of nature.

This text presents a few preliminary results of research currently being conducted at the Université de Sherbrooke’s Research Institute on Educational Practices. The study seeks to understand how situations presented in teacher education can support the functioning and success of trainee teachers’ professional learning. The article’s aim is to identify the points of convergence between situations of professional activity, situations of professional learning, and training situations. The text will attempt to analyze the role that can be played by certain training (...) structures that seek to support a professionalization process that we define in terms of a general aim: the construction of professional knowledge. The originality of this research lies in that it draws on the work of Gaston Bachelard to develop a theoretical frame enabling a reading and interpretation of the results. Ce texte présente quelques résultats préliminaires d’une recherche menée présentement à l’Institut de recherche sur les pratiques éducatives de l’Université de Sherbrooke. Cette recherche vise à comprendre comment les situations présentes dans la formation à l’enseignement peuvent soutenir le fonctionnement et la réussite de l’apprentissage professionnel des enseignants en formation. Nous cherchons à identifier les points de rencontre entre les situations d’activité professionnelle, les situations d’apprentissage professionnel et les situations de formation. Nous tenterons d’analyser le rôle que peuvent jouer certains dispositifs visant à soutenir un processus de professionnalisation que nous définissons au regard d’une finalité : la construction de savoirs professionnels. I explore what BernardWilliams means by regarding one’s action ‘purely externally, as one might regard anyone else’s action’, and how it links to regret and agent-regret. I suggest some ways that we might understand the external view: as a failure to recognize what one has done, in terms of Williams’s distinction between intrinsic and extrinsic luck, and as akin to Thomas Nagel’s distinction between an internal and external view. I argue that none of these captures what Williams was getting at (...) because they do not allow one to take a view on one’s action. I offer two alternative accounts. One turns around what we identify with, the other concerns what we care about. Both accounts capture how I might regret, rather than agent-regret, my own action. I demonstrate that these accounts can explain the relationship between an insurance payout and the external view, and they can explain the agent-relativity of agent-regret. (shrink)

Termillä ”poliittinen köyhyys” on aiemmin tarkoitettu resurssien köyhyydestä erillistä köyhyyden muotoa, jossa ihmiset kärsivät vaikuttavan vapauden tasa-arvon puutteesta eli kyvyttömyydestä osallistua tasa-arvoisina toimijoina poliittiseen vaikuttamiseen. Tässä artikkelissa etsin filosofista lähestymistapaa, jonka avulla olisi mahdollista diagnosoida poliittisen osallistumisen epätasa-arvoa myös henkilökohtaisen poliittisen toimijuuden kokemuksen katoamisena. En käsittele niitä varsinaisia prosesseja, joiden myötä poliittinen osallistuminen käy joillekuille mahdottomaksi. Sen sijaan pyrin kuvailemaan poliittista köyhyyttä yleisemmin, osallistumisen kokemuksellisten ehtojen katoamisena. Artificial intelligence (AI) profoundly influences a number of societal structures today, including religious dynamics. Using Bernard Lonergan’s critical realism as a lens, this article investigates the intersections of AI and religious traditions in their shared pursuit of the common good. Beginning with Lonergan’s principle that humans construct their understanding through cognitive processes, we examine how AI-mediated realities align with or challenge traditional religious tenets. By delving into specific cases, we spotlight AI’s role in reshaping religious symbols, rituals, and even (...) creating novel spiritual meanings. Using Lonergan’s insights on the balance between subjectivity and objectivity, I analyze AI’s potential to both create new sacred spaces and challenge religious orthodoxy. The crux of the discussion centers on the negotiation between religious values and technological innovation, assessing how AI can bolster religious life while maintaining its core essence. Ultimately, this article underscores the importance of the common good in the age of AI-driven religious evolution. (shrink)

In recent years, the practice of tax exemption for churches has become a source of open scrutiny, argument, and controversy on the part of both government and religious leaders. The study attempted to assess the main principles that government base on to impose taxes on its citizenry and to assess the tax exemption status of the churches in Ghana. Exploratory, descriptive and cross-section surveys were used to investigate and discover from respondent’s information on the topic to provide a report on (...) the background, facts, settings and concerns about the principles of taxation and the tax exemption status of churches. The study considered 120 people as its targeted sample of which 114 responded by the use of questionnaires. Also, descriptive analysis such as frequency and percentages were used to analyse the data. From the information gathered on the research, it was revealed that most Ghanaians representing 65.8% prefer the government to allocate taxes based on the benefits that taxpayers receive for paying taxes rather than the ability to pay or any other principle for the allocation of taxes. In addition, 57% of Ghanaians would like the religious organizations to enjoy their tax-exempt status despite allegation by critics that they are amassing wealth for themselves and not contributing to the development of Ghana. Some of the reasons given were that: churches are not profit-making businesses; churches contribute to the development of the nation; churches care for the people more than the government. Some of them concluded that failure to grant the church tax exemption may give room for the churches to engage in business activities. For those with the opposing view, some gave reasons such as: churches have become some sort of commerce; the churches have more money in this world; the payment of taxes by churches may as well boost the revenue of the government. Despite the various arguments, there was an agreement that the Ghana Revenue Authority should check the sales of rosaries, anointing oil, holy water, charge of consultation fees, as these should attract taxation. The paper recommends that Tax-Exempt Division should develop policies and administer tax exempt organizations (including religious organizations) laws. The division should be responsible for exempt organizations tax education and training to enable them understand their tax law obligations. This will improve tax compliance by the exempt organizations. (shrink)

George Bernard Shaw did various things to make his essays readable, such as using short sections. In this paper, I raise the worry that they are at risk of being replaced by vocabulary and sayings from folk culture.

Bernard Williams thought that philosophy should address real human concerns felt beyond academic philosophy. But what wider concerns are addressed by Ethics and the Limits of Philosophy, a book he introduces as being ‘principally about how things are in moral philosophy’? In this article, we argue that Williams responded to the concerns of his day indirectly, refraining from explicitly claiming wider cultural relevance, but hinting at it in the pair of epigraphs that opens the main text. This was Williams’s (...) solution to what he perceived as the stylistic problem of how to pursue philosophy as cultural critique. Taking the epigraphs as interpretative keys to the wider resonances of the book, we show how they reveal Williams’s philosophical concerns – with the primacy of character over method, the obligation to follow orders, and the possibility of combining truth, truthfulness, and a meaningful life in a disillusioned world – to be recognisably rooted in the cultural concerns of post-war Britain. In the light of its epigraphs, the book emerges as the critique of a philosophical tradition’s inadequacies to the special difficulties of its cultural moment. (shrink)

In every UG, PG examination, one is asked about the importance of the title of Shaw's play. In this paper I have illustrated by my own reading how one should and can approach the play. For scholars, my annotations referring to (...) John of Patmos may be interesting. "No, your honor. I didn't know who or what he was when I first came across the book -- they don't exactly love him in the synagogue, if you've read the story of his life. I found it in a junkyard in a nearby town, paid a kopek, and left cursing myself for wasting money hard to come by. Later I read through a few pages and kept on going as though there were a whirlwind at my back. As I (...) say, I didn't understand every word but when you're dealing with such ideas you feel as though you were taking a witch's ride. After that I wasn't the same man. That's in a manner of speaking, of course, because I've changed little since my youth.". The speaker is Yakov Bok, the unlikely hero of Bernard Malamud's The Fixer. At this point, early in the novel, Yakov speaks truthfully when he says that he has changed little since his youth. But over the next two and a half years (the time-period covered in the novel), he will undergo profound change and impressive moral growth. He suffers; he learns; he grows. Spinoza's name and ideas appear again and again at crucial moments in the course of the hero's moral development. Yakov Bok's verbal account of Spinoza's ideas is often comically primitive, but his understanding far outstrips his ability to articulate. By the end of the novel, his sufferings have led him to a deep grasp of certain of Spinoza's ethical and political doctrines. (shrink)

The guise of the good is the thesis that an agent can only want, or intentionally do or pursue something, if and because this seems good to the agent in some respect or other. Bernard Williams criticizes the guise of the good in Ethics and the Limits of Philosophy. In this paper I reconstruct and assess his hitherto unnoticed critical remarks. Williams's opposition is based on the idea that it takes an “extra step” to go from desiring or pursuing (...) something to thinking of it as good. To show this, he employs an argument from elimination (with two strands: an argument from personal ends and an argument from immediate ends), and a separate argument which I call the one‐desire argument. I review and reject two types of answers to Williams's objections: answers that explore different varieties of what it can mean to “think of as good,” and answers that focus on different varieties of goodness under the guise of which one can desire something. I then consider whether a different, but nearby thesis, namely the guise of normative reasons, can accommodate Williams's objections, concluding that this alternative also fails. I end by looking at how this debate might move forward. (shrink)

This paper develops Bernard Williams’s suggestion that for philosophy to ignore its history is for it to assume that its history is vindicatory. The paper aims to offer a fruitful line of inquiry into the question whether philosophy has a vindicatory history by providing a map of possible answers to it. It first distinguishes three types of history: the history of discovery, the history of progress, and the history of change. It then suggests that much of philosophy lacks a (...) vindicatory history, for reasons that reflect philosophy’s character as a humanistic discipline. On this basis, the paper reconstructs Williams’s conception of what it means for philosophy to engage with its own history. The paper concludes that it is a mistake to think that a vindicatory history is what we would really like to have, and that in fact, the resulting picture gives philosophy several reasons to engage with its own history. Bernard Williams’ books demand an unusual amount of work from readers. This is particularly true of his 1985 magnum opus, Ethics and the Limits of Philosophy (ELP)—a work so charged with ideas that there seems to be nothing more to say, and yet at the same time so pared-down and tersely argued that there seems to be nothing left to take away. Reflecting on the book five years after its publication, Williams writes that it is centrally concerned with a (...) Nietzschean question: the question of philosophy’s authority, in particular when it comes to telling us how to live (1990, p. XIX). Some ethical theories seem implicitly committed to the idea that philosophy has everything to tell us about how to live. This Williams rejects. But the question then is how much philosophy has to tell us, and as critical as Williams may be of philosophy’s ambitions in this regard, his answer in ELP is certainly not nothing. The book even suggests some things that philosophy might say. But what Williams emphatically insists on, both in the book and in his later reflection on it, is that the question needs to be taken more seriously than it has been. (shrink)

A short account of the philosopher Bernard Mandeville's key ideas.

In Truth and Truthfulness, Bernard Williams sought to defend the value of truth by giving a vindicatory genealogy revealing its instrumental value. But what separates Williams’s instrumental vindication from the indirect utilitarianism of which he was a critic? And how can genealogy vindicate anything, let alone something which, as Williams says of the concept of truth, does not have a history? In this paper, I propose to resolve these puzzles by reading Williams as a type of pragmatist and his (...) genealogy as a pragmatic genealogy. On this basis, I show just in what sense Williams’s genealogy can by itself yield reasons to cultivate a sense of the value of truth. Using various criticisms of Williams’s genealogical method as a foil, I then develop an understanding of pragmatic genealogy which reveals it to be uniquely suited to dealing with practices exhibiting what I call self-effacing functionality—practices that are functional only insofar as and because we do not engage in them for their functionality. I conclude with an assessment of the wider significance of Williams’s genealogy for his own oeuvre and for further genealogical inquiry. (shrink)

B a c k g r o u n d . The article is devoted to the Minnemystik of Hadewijch of Brabant in the XIII century. It deals with the genesis of Hadewijch's concept of Minne in its relation to the monastic Cistercian mysticism of Bernard of Clairvaux, William of Saint-Thierry in the XII century and Beatrice of Nazareth in the XIII century. It also considers the conception of theologist and philosopher Richard of Saint-Victor in the XII century. Considering (...) the existing advances of researchers on Hadewijch's Minnemystik, since the XX century, this investigation especially focuses on the primary role of the secular tradition of minnesingers and trobairitz of the mid-XIII century in her texts. M e t h o d s . The main method of the article is a comparative analysis. It is used to find the common meaning of Minne in two traditions: secular and religious minnesingers. The historical-philosophical approach allows us to demonstrate the conceptual link between monastic theology in the XII–XIII centuries and Hadewijch's beguinal Minnemystik. R e s u l t s . The article sheds light on Hadewijch's concept of the Minne and stresses the primary role of the secular and religious conceptions of predecessors and contemporaries in Hadewijch's Minnemystik. C o n c l u s i o n . The author underlines that Hadewijch's concept of Minne comes from the secular tradition of minnesingers and, especially, trobairitz. It also derives from the XII-century male and female mystic theology, which follows Augustine. Thus, the concept of the Minne is deeply connected with the notion of Amor and the tradition of "courtly love", and with Caritas and the tradition of "pure love". Bernard Williams is widely recognized as belonging among the greatest and most influential moral philosophers of the twentieth-century – and arguably the greatest British moral philosopher of the late twentieth-century. His various contributions over a period of nearly half a century changed the course of the subject and challenged many of its deepest assumptions and prejudices. There are, nevertheless, a number of respects in which the interpretation of his work is neither easy nor straightforward. One reason for this is (...) that both his views and his methods evolved and shifted in significant ways, especially around the time that he wrote and published Ethics and the Limits of Philosophy (i.e. the early 1980s). One way of gauging and assessing these changes in Williams’ views and outlook is to consider his relationship and attitude to other philosophers during this period. Of particular interest is his changing attitude to the moral philosophy of David Hume. This relationship is of considerable importance, not only because it serves as a useful tool for the interpretation of Williams’ views but also because it provides us with some critical insight into the respective strengths and weaknesses of both Hume’s and Williams’ contributions. -/- . This article explores the potential of Bernard Lonergan’s philosophy of subjectivity as objectivity as a grounding for value sensitive design (VSD) and the design turn in applied ethics. The rapid pace of scientific and technological advancement has created a gap between technical abilities and our moral assessments of those abilities, calling for a reflection on the philosophical tools we have for applying ethics. In particular, applied ethics often presents interconnected problems that require a more general framework for ethical reflection. (...) Lonergan’s philosophy, which emphasizes the importance of self-understanding and self-transcendence in achieving objectivity, can provide a valuable perspective on VSD and the design turn in applied ethics. The article examines how Lonergan’s philosophy can be applied to VSD and the design turn, and how scientific knowledge can be integrated into an ethics of science without reducing it to an external reflection. By adopting Lonergan’s perspective, we can address the ethical challenges arising from scientific and technological advancements while promoting a more holistic approach to applied ethics. (shrink)

This chapter argues that several aspects of Bernard Williams’s style, methodology, and metaphilosophy can be read as evolving dialectically out of Wittgenstein’s own. After considering Wittgenstein as a stylistic influence on Williams, especially as regards ideals of clarity, precision, and depth, Williams’s methodological debt to Wittgenstein is examined, in particular his anthropological interest in thick concepts and their point. The chapter then turns to Williams’s explicit association, in the 1990s, with a certain form of Wittgensteinianism, which he called ‘Left (...) Wittgensteinianism’. It is shown how this is not a sudden conversion, but the direct product of Williams’s longstanding critical engagement with Wittgenstein’s methodology and metaphilosophy: Williams arrives at this position by envisaging a Wittgensteinianism that thinks in concrete sociohistorical terms, embraces genuine explanation, and relinquishes its insistence on the purity of philosophy. When properly understood, moreover, this critique turns out to be continuous with Williams’s advocacy of a conception of philosophy as a humanistic discipline. Finally, it is shown that Williams inherits from Wittgenstein a certain understanding of how philosophy can help us to live, in particular the therapeutic ambition to liberate us from distortions in our self-understanding by assembling reminders. Drawing upon the life and work of S. Kay Toombs, I explore the impact and import of phenomenological accounts of disability for the existentialist tradition. Through the case of multiple sclerosis, a noncongenital, late-onset, and degenerative disability, I show how the general structures that emerge from its lived experience largely support a mere-difference view of disability and highlight the need for an equitably habitable world. I further argue that phenomenological accounts of disability demonstrate accessibility to be the defining feature of (...) what it means to be embodied as we are. I conclude with a discussion of the more general philosophical relationship between disability, embodiment, and existentialism. (shrink)
